Agreement between User and Mattawa Hospital

The Mattawa Hospital 50/50 website (the “Web Site”) is comprised of various web pages operated by Hôpital de Mattawa Hospital (“Mattawa Hospital”), 217 Turcotte Park Road, P.O. Box 70, Mattawa, Ontario P0H 1V0, Canada, for the purpose of conducting a charitable 50/50 raffle under Raffle licence RAF1383227 issued by the Alcohol and Gaming Commission of Ontario (AGCO).

The Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions and notices contained herein, together with the Rules of Play, the Privacy Policy and the Cookie Policy, which are incorporated by reference. Your use of the Web Site, and any purchase of raffle tickets, constitutes your agreement to all such terms, conditions and notices.

Modification of these Terms of Use

Mattawa Hospital reserves the right to change the terms, conditions and notices under which the Web Site is offered, including but not limited to ticket prices and packages, by posting the revised version on this page. Ticket prices, sales periods and draw dates in effect for a given draw are those approved under the raffle licence and published in the Rules of Play.

Eligibility and Ticket Purchases

You must be at least 18 years of age to use the Web Site to purchase tickets.
You must be physically located in the Province of Ontario at the time of any ticket purchase. Mattawa Hospital may use technical means, including IP and device location, to confirm your location, and may cancel purchases that do not meet this requirement.
You must not be a person excluded from participation under the Rules of Play.
You must provide accurate, current and complete information when purchasing and keep your email address and telephone number current so that tickets can be delivered and you can be contacted if you win.

A purchase is complete only when payment has been successfully processed (Online payment for raffle ticket purchases) and a confirmation email with ticket numbers has been issued. All sales are final; tickets are non-refundable and non-transferable except as required by law or AGCO requirements.

Nature of the Raffle

The Web Site offers a charitable 50/50 raffle only. It is not an online casino, sportsbook or other gaming service. The prize is 50% of ticket sales for each draw and is not a fixed or guaranteed amount. Purchasing a ticket does not guarantee a prize; the odds of winning depend on the number of tickets sold. Net proceeds support priority medical equipment for Hôpital de Mattawa Hospital.

The Web Site may contain links to other websites (“Linked Sites”), such as the payment processor and ConnexOntario. The Linked Sites are not under the control of Mattawa Hospital and Mattawa Hospital is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Mattawa Hospital is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Mattawa Hospital of the site or any association with its operators.

No Unlawful or Prohibited Use

As a condition of your use of the Web Site, you warrant to Mattawa Hospital that you will not use the Web Site for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the Web Site in any manner which could damage, disable, overburden or impair the Web Site or interfere with any other party's use and enjoyment of the Web Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Web Site. In particular, you may not attempt to purchase tickets from outside Ontario, on behalf of ineligible persons, or by means of automated tools.

Materials Provided to Mattawa Hospital

Mattawa Hospital does not claim ownership of the materials you provide to Mattawa Hospital (including feedback and suggestions) or submit through the Web Site (collectively “Submissions”). However, by providing or submitting your Submission you are granting Mattawa Hospital permission to use your Submission in connection with the operation of the Web Site and the raffle. No compensation will be paid with respect to the use of your Submission. By accepting a prize, the winner agrees that Mattawa Hospital may publish their name, community, winning ticket number and prize amount for the purpose of announcing the results of the draw, as set out in the Rules of Play.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE WEB SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. MATTAWA HOSPITAL AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE WEB SITE AT ANY TIME.

MATTAWA HOSPITAL AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE WEB SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MATTAWA HOSPITAL AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE WEB SITE, WITH THE DELAY OR INABILITY TO USE THE WEB SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE WEB SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE WEB SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MATTAWA HOSPITAL OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. Termination / Access Restriction

Mattawa Hospital reserves the right, in its sole discretion, to terminate your access to the Web Site and the related services or any portion thereof at any time, without notice, including where these Terms or the Rules of Play have been breached.

General

To the maximum extent permitted by law, this agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and you hereby consent to the exclusive jurisdiction and venue of the courts of Ontario in all disputes arising out of or relating to the use of the Web Site. Use of the Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment or agency relationship exists between you and Mattawa Hospital as a result of this agreement or use of the Web Site. Mattawa Hospital's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Mattawa Hospital's right to comply with governmental, court, regulatory and law enforcement requests or requirements relating to your use of the Web Site or information provided to or gathered by Mattawa Hospital with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement, together with the Rules of Play, constitutes the entire agreement between the user and Mattawa Hospital with respect to the Web Site and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Mattawa Hospital with respect to the Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be drawn up in English.
